The defendant has appealed from a trIal court decision refusing to apply recent amendments to RCW 9.94A.120(6), the Drug Offender Sentencing Alternative, in imposing sentence. There is no cross appeal and there appear to be no other issues in this case. The defendant committed an offense prior to July 25, 1999, but was sentenced after that date. In State v. Kane, 101 Wn. App. 607, P.2d (2000), (review denied under Supreme Court Cause No. 70093-1, 10/11/00), this Court held that the amended eligibility criteria for an alternative sentence do not apply to crimes committed before the effective date of the amendments. In light of Kane, we lift the stay, summarily affirm the trial courts decision, and do not reach the States motion on the merits.
